The petitioner is in custody since 21.02.2018 in connection with Bakhari P.S. Case No. 296 of 2017 registered for the offence under Sections 461 and 379 of the Indian Penal Code. Learned counsel for the petitioner submits that the allegation of theft made against the petitioner is false and he has got no criminal antecedent. Intially, he was not named in the F.I.R. nor any recovery was made from his possession rather it is alleged that the petitioner's Sim Card was used in a Mobile Phone which had been allegedly stolen from the shop of the informant.
