2. This is the 2nd attempt of the petitioner. Earlier the bail application of the petitioner was rejected vide order dated 17.02.2024 passed in Cr. Misc. No. 5932 of 2024.

3. The petitioner seeks regular bail in a case registered for the offence under Sections 406, 420, 467, 468, 471, 120B/34 of the Indian Penal Code.

4. The following order was passed on 17.02.2024 in Cr. Misc. No. 5932 of 2024 Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner seeks bail in connection with Shekhopur Sarai P.S.

Case No. 04 of 2018 registered for the

Patna High Court CR. MISC. No.79336 of 2024(3) dt.07-02-2025 2/3 offence punishable under Sections 406, 420, 467, 468, 471 and 120B/34 of the Indian Penal Code.

3. As per the prosecution case, some miscreants were cheating money from people to become the agents of shopping company in lucky draw and were collecting money. The police raided the place and three miscreants were apprehended who disclosed the name of the petitioner. The petitioner and others succeeded in fleeing away from the spot.

4. The petitioner has five more similar antecedents. It appears that the petitioner is involved in cheating people of their hard earned money. The petitioner is in jail since 23.11.2023 and is committing crimes after being released on bail once he is caught. It has been argued by the learned counsel for the petitioner that the similarly situated accused persons have been granted bail.

5. In view of criminal antecedents and also the facts of the case, I am not inclined to grant bail to the petitioner.

Accordingly, the application stands dismissed.

7. The Court below is directed to expedite the trial.

5. In the trial out of 8 witnesses, four witnesses have been examined.

6. Considering the fact that the trial is going on and also considering the law laid down by the Hon'ble Supreme Court in the case of X vs. State of Rajasthan, 2024 SCC OnLine SC 3539, I am not inclined to grant bail to the petitioner.

6. Accordingly, this application for regular bail is hereby rejected.
