The petitioner seeks regular bail in connection with NDPS Case No.21 of 2018 arising out of NCB Case No.

NCB/PZU/V/21/2018 for the offences punishable under Section(s) 21, 22, 23 and 29 of the NDPS Act.

The allegation is regarding the recovery of various bottles of medicines cough syrup codeine substance which is ban item under the NDPS Act.

The learned counsel for the petitioner submits that the petitioner is the businessman and selling medicine since a long time and the said substance cough syrup codeine is permitted to use in the manufacturing of cough syrup, hence the same would not come within the purview of NDPS Act.

No.32052 of 2018 (2) dt.24-05-2018 2/2 It is further submitted that the petitioner is ready to cooperate with the investigation and is ready to give undertaking that he will not free away. The petitioner having a clean antecedent and is languishing in custody since 16.04.2018. Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (rupees Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge/ Special Judge, East Champaran, Motihari in connection with NDPS Case No. 21 of 2018 arising out of NCB Case No. NCB/PZU/V/21/2018.

The learned counsel for the Union of India submitted that the petitioner be directed to cooperate with the investigation and in such view of the matter, the petitioner shall cooperate with the investigation and shall be present as and when required by the investigating agency and investigating agency directed him to be present and in case of any default thereof, the prosecution shall be free to approach this Court for cancellation of the bail.
