The petitioner seeks regular bail in connection with Sanokhar P.S. Case No. 38 of 2018 for the offences punishable under Sections 30(A) and 30(F) of Bihar Prohibition and Excise Act, 2016 and under sections 188 and 290 of Indian Penal Code. The allegation is regarding recovery of 200 liters of illicit country made liquor and 80 bottles of foreign liquor from a Scorpio vehicle.

The learned counsel for the petitioner submits that neither the petitioner is owner of the said vehicle nor any recovery has been made from his conscious possession. It is further submitted that the petitioner is having a clean antecedent and is languishing in custody since 02.04.2018.

Patna High Court Cr.Misc. No.31794 of 2018 (2) dt.31-05-2018 2/2 Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Bhagalpur in connection with Sanokhar P.S. Case No.38 of 2018.
