1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 323, 379, 504, 506, 498A and 34 of the Indian Penal Code.

3. Learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and being husband has been falsely implicated in the present case, it is next submitted that from perusal of the office report, it would manifest that the same records that the O.P. No. 2 refused to accept the registered notice, in view of the submissions made by the learned counsel for the petitioner and the office report, the

4. Learned counsel for the petitioner further submits that the petitioner is willing to revive the conjugal relationship and will keep the informant with dignity and honour and shall ensure her well being, it is next submitted that it appears that the informant herself is not interested in reviving the conjugal relationship, as such, she has not appeared to contest the case, it is also submitted that the petitioner will pay an amount of Rs. 2,000/- per month to the informant for maintenance, it is also submitted that presently the petitioner does not have the bank account number of the informant but he will be trying to obtain the same and once the bank account number is obtained, the maintenance as agreed shall commence, it is also submitted that in any view of the matter, the petitioner will start paying the maintenance from 01.09.2023.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 5,000/- (Rupees

No.74805 of 2022(4) dt.08-08-2023 3/3 Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Dandari P.S. Case No. 68 of 2020 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.

7. However, the informant would be at liberty to file an application seeking cancellation of the anticipatory bail order of the petitioner in the event if the petitioner does not pay the amount as agreed to the informant for two consecutive months. (Satyavrat Verma, J) HarshPandey/- U T
