The instant application for regular bail has been filed by the petitioner registered for the offence punishable under Sections 363, 366/34 of the Indian Penal Code. Prosecution case relates to abduction of daughter of the informant by the petitioner's son.
Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. Petitioner is an old man of 64 years, lives separately from his son. There is delay of 14 days in lodging the FIR. Specific allegation is against accused, Ravi Kumar and not against the petitioner. He has no concern with the alleged incident. Patna High Court CR. MISC. No.79249 of 2023(2) dt.13-12-2023 2/2 between the petitioner's son and daughter of the informant and after solemnizing marriage, they are leading their marital life. Petitioner has got no criminal antecedent and languishing in judicial custody since 28.07.2023.
Learned APP appearing for the State has opposed the prayer of Bail.
Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-VI-cum-Special Judge, POCSO, Vaishali Hajipur in connection with Lalganj P.S. Case No. 383 of 2022.
