Petitioner, already in custody, seeks bail in connection with Town Thana P.S. Case No.113 of 2018 registered under Section 414 of the Indian Penal Code.
Allegation in brief is that one stolen motorcycle was recovered from the verandah of the house of the petitioner. Learned counsel for the petitioner submits that someone had parked the motorcycle in the verandah which is accessible to anyone in the night and informed the police; moreover this petitioner has no criminal antecedent. Having considered the aforesaid facts and circumstances, petitioner Mantu Kumar is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten
Patna High Court Cr.Misc. No.36153 of 2018(3) dt.11-07-2018 2/2 thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Saran at Chapra in connection with Town Thana P.S. Case No.113 of 2018 subject to verification of criminal antecedent of the petitioner.
If any criminal antecedent is found against this petitioner, he shall not be released.
