Heard learned counsel for the petitioners and the learned AC to GP-20.

The learned counsel appearing on behalf of the petitioner submits that the instant writ application has been filed seeking a direction upon the respondent authorities to pay difference of selection grade scale of Inter Trained Teacher from 1-8-1975 to 31-12-2007 in terms of Memo No. 3150 dated 1011-2016 (Annexure-1) issued by the District Education Officer, Bhagalpur and also to return the deducted the amount of Rs. 9125/- in terms of Memo No. 1944 dated 29-8-2018 issued by

2/4 the District Programme Officer (Establishment), Bhagalpur. 3.

The learned counsel for the petitioner submits that petitioner joined as a Matric Trained Assistant Teacher in the Middle School, Shahkund, District-Bhagalpur on 7-4-1973 and thereafter was promoted as Inter Trained Assistant Teacher, Middle School, Shahkund, District-Bhagalpur on 26-11-1976. It is further submitted that petitioner, after rendering blemishless services, retired on 13-12-2007.

It is next submitted that vide Memo No. 3150 dated 10-11-2016 issued by the District Education Officer, Bhagalpur (Annexure-1), the petitioner along with others have been granted selection grade scale from 1-4-1998 till the date of superannuation and the name of the petitioner finds mentioned at Serial No. 223 of the letter dated 10-11-2016, but the petitioner has not been given the benefit of selection grade scale. It is next submitted that if the petitioner is granted the benefit of selection grade, in that event his pension amount will also change.

It is further submitted that petitioner submitted his representation dated 10-5-2022 (Annexure-2) before the District Programme Officer (Establishment), Bhagalpur (Respondent No. 6) seeking redressal of his grievance as raised in the instant

3/4 writ application. It is next submitted that the representation of the petitioner dated 10-5-2022 was received in the office of the District Programme Officer (Establishment), as would manifest from the receiving given, but then till date no action has been taken.

The learned counsel appearing on behalf of the State submits that the writ application can be disposed of with a direction to the District Programme Officer (Establishment), Bhagalpur, to consider and dispose of the representation of the petitioner dated 10-5-2022, but then it is submitted that it may be a possibility that the representation of the petitioner dated 105-2022 may not be located in the office of District Programme Officer, on which learned counsel appearing on behalf of the petitioner submits that petitioner will file a fresh representation before the District Programme Officer (Establishment), Bhagalpur, on or before 21-3-2025.

After hearing the learned counsel for the parties, the writ application is disposed of with a liberty to the petitioner to file a fresh representation before the District Programme Officer (Establishment), Bhagalpur, with regard to the grievance as raised in the instant writ application.

It is made clear that if any representation on behalf

4/4 of the petitioner is filed on or before 21-3-2025 seeking redressal of his grievance as raised in the instant writ application, the District Programme Officer (Establishment), Bhagalpur, shall dispose of the representation in accordance with law within a period of two months thereafter.
