ANJANA MISHRA ORAL ORDER 28-06-2018 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 07.02.2018 in connection with Motihari Muffasil P.S. Case No.257 of 2014 registered for the offence under Sections 379 and 420/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is one of the Drivers of the informant and plies his vehicle, as and when hired by the potential customers. It is further submitted that the petitioner normally drives the vehicle, bearing Registration No.BR 10A 2559, whereas the vehicle in question, which was lost, is bearing Registration No.BR 31 7774. It is further submitted that the petitioner has no connection

Patna High Court Cr.Misc. No.31949 of 2018 (3) dt.28-06-2018 2/2 with the alleged vehicle, which was stolen or came to be missing, but only on the basis of suspicion, the present petitioner was arrested. It is further submitted that the informant was annoyed with the petitioner for taking shelter of Panchayat for settling his grievance and, therefore, roped in connection with the present case.

Having heard learned counsel for the petitioner and the learned counsel for the State and there being no cogent material to indicate the petitioner's involvement, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Motihari, East Champaran, in connection with Motihari Muffasil P.S. Case No.257 of 2014.
