The petitioner seeks regular bail in connection with Jandaha P.S. Case No. 1 of 2019, registered for the offence punishable under Section 394 of the Indian Penal Code, 1860 and Section 27 of the Arms Act.

The allegation is regarding jewellery being stolen from the informant by three unknown miscreants after intercepting the informant on pistol point.

The learned counsel for the petitioner has submitted that the petitioner has been made an accused in the present case upon the confessional statement made by the co-accused person, namely, Pankaj Kumar and the said Pankaj Kumar has already been granted bail by a coordinate Bench of

Patna High Court CR. MISC. No.72200 of 2019(2) dt.04-12-2019 2/2 this Court vide order dated 16.7.2019 passed in Criminal Miscellaneous No. 42393 of 2019 and as far as the present case is concerned, he is languishing in custody since 20.8.2019. Lastly, it is submitted that neither any recovery has been made from the petitioner nor there is any material to show the complicity of the petitioner in the alleged occurrence.

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.

Accordingly, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned 11th Additional Chief Judicial Magistrate, Vaishali at Hajipur in connection with Jandaha P.S. Case No. 1 of 2019.
