2. The petitioners have prayed for regular bail in a case registered for the offense punishable under Sections 308(5) & 3(5) of the Bharatiya Nyaya Sanhita.
3. The case of the prosecution is that the petitioner along with Ram Ratan Choudhari went on the shop of the informant. It is alleged that Ram Ratan Choudhari took articles worth Rs. 1,52,000/- and when the informant demanded the bills, he threatened him of dire consequences.
4. Learned counsel for the petitioners submits that the petitioners are innocent and have committed no offence. They have falsely been implicated in this case. It is also submitted that specific allegation is against Ram Ratan Choudhari. There is no specific allegation against the petitioners. It is further submitted that the petitioner namely, Jitendra Chaudhari @ Karan Raj is languishing in judicial custody since 02.09.2024 whereas petitioner namely, Sonu Choudhary @ Baila is in custody since 20.08.2024.
5. Learned APP appearing for the state and learned counsel for the informant have opposed the prayer of regular bail and submits that petitioner namely, Jitendra Chaudhari is having criminal antecedent of two cases whereas petitioner namely, Sonu Choudhary is having criminal antecedent of three

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioners namely, Jitendra Chaudhari and Sonu Choudhary on bail. The above named petitioners are directed to be released on bail in connection with Sikandra P.S. Case No. 255 of 2024 on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jamui.
