The petitioner is apprehending his arrest in connection with Town P.S.Case nO.560 of 2010 registered for offences punishable under Sections 420, 467, 468, 471, 474, 413, 414 and 120(B)/34 of the Indian Penal Code.

Allegation against the petitioner as per FIR is that the police arrested one broker Arvind Kumar Jha from the D.T.O. office and he has confessed that other accused persons bring stolen motorcycle and he used to make papers of those vehicles and in that connection he has named the petitioner also. Submission of the learned counsel for the petitioner is that there is no recovery from the possession of the petitioner and except confessional statement there is no allegation against the

Patna High Court Cr.Misc. No.37371 of 2018 (3) dt.12-07-2018 2/2 petitioner. It has also been submitted that though he is accused in one more case but he has been granted bail in this case. Heard learned A.P.P. also.

Having heard both sides and in view of allegation as well as criminal antecedent, I am not inclined to grant anticipatory bail to the petitioner rather let the petitioner surrender before the learned court below within a period of four weeks from the date of receipt of the order and make prayer for regular bail, which will be considered by the learned court below on its own merit.
