The petitioner is in custody since 28.03.2018 in connection with Jamalpur P.S. Case No. 02 of 2010 for the offence registered under Sections 307, 302/34 and 120(b) of the Indian Penal Code and Section 27 of the Arms Act. Learned counsel for the petitioner submits that the main allegation is against co-accused, namely, Gautam Kumar Mandal, Pato Mandal and Bhajan Kumar Mandal and not against this petitioner. It is further submitted that this petitioner has no connection even remotely with the aforesaid accused persons, he had only called the deceased to take tea.
Learned counsel for the State after perusal of the case diary submits that there is no material in the case diary to indicate that the petitioner was connected with the accused persons. Considering the aforesaid facts and circumstances of
Patna High Court Cr.Misc. No.33237 of 2018 (3) dt.04-07-2018 the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, RailwayKiul (Lakhisarai) in connection with Jamalpur P.S. Case No. 02 of 2010.
