ANJANA MISHRA ORAL ORDER 09-07-2018 Heard learned counsel for the petitioners and the learned counsel appearing on behalf of the State. The petitioners are in custody since 19.02.2018 in connection with Bisfi P.S. Case No.239 of 2017 registered for the offences under Sections 147, 148, 149, 341, 323, 307, 302 and 504 of the Indian Penal Code.
Learned counsel for the petitioners submits that the main allegation is against Md. Mehraj, Md. Tausif and Md. Tahir and not against the present petitioners. It is further submitted that the occurrence as alleged took place on account of petty dispute between the petitioners and the children of the family of the deceased and these petitioners had no role to play
Patna High Court Cr.Misc. No.33374 of 2018 (3) dt.09-07-2018 2/2 in the occurrence, save and except that they were bystanders. It is further submitted that no overt act has been attributed to them and they have also no criminal antecedents.
Considering the aforementioned facts and circumstances of the case, let the petitioners, above named, be released on bail on their furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Benipatti, Madhubani, in connection with Bisfi P.S. Case No.239 of 2017.
