JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 05-06-2018 Heard learned counsel for the petitioners and State. The petitioners are in custody in connection with Fatuha P.S. Case No. 191 of 2018 for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioners submits that the petitioner no.2 has no criminal antecedent. So far as petitioner no.1 is concerned, he is accused in Fatuha P.S. case no. 6 of 2018 for the offence under Sections 341, 323, 504, 307/34 of the Indian Penal Code. He further submits that the petitioners are in custody since 02.04.2018. Referring to the seizure list, learned counsel for the petitioners submits that the petitioners have been falsely implicated in this case, as he was spectator where the liquor was seized, liquor does not belong to the petitioners.

No.32495 of 2018 (2) dt.05-06-2018 2/2 Considering the aforesaid, the petitioners, named above, are directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna in connection with Fatuha P.S. Case No. 191 of 2018.
