2. The petitioner is in custody in connection with Mashkaur P.S Case No. 152 of 2025 registered for the offences punishable under Sections 303(2)/317(4), 3(5) of the BNS.

3. As per allegation in the FIR, one stolen motorcycle red coloured Honda Shine SP Motorcycle with Reg. No. BR01DK-5247 and one master key was recovered from the pocket of the arrested person.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. He next submits that petitioner is not named in the FIR. His name has come in this case on the basis of confessional statement of co-

Patna High Court CR. MISC. No.75043 of 2025(2) dt.19-11-2025 2/2 accused Badal Kumar & Suraj Kumar and there is no specific allegation against the petitioner. It is also submitted that petitioner is in judicial custody since 05.08.2025 having one criminal antecedent.

5. However, learned APP for the State oppose the prayer for regular bail of the petitioner.

6. On perusal of the FIR and impugned order dated 18.09.2025, it appears that petitioner has not been arrested from the spot. His name has been figured from the confessional statement of the arrested accused persons. Moreover, petitioner possesses only one criminal antecedent let the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-IV, Nawada in connection with Mashkaur P.S Case No. 152 of 2025 subject to the condition that petitioner shall remain physically present on each and every date fixed by the Trial Court till the conclusion of the Trial.
