JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 04-06-2018 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Gaya Rail P.S. case no. 54 of 2018 for the offence under Sections 401/414 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. The petitioner is in custody since 26.02.2018. He further submits that there is no case of theft and in absence of lodging of case under Section 379 of the Indian Penal Code, the case under Section 414 of the Indian Penal Code is unsustainable.

Considering the fact that the petitioner has no criminal antecedent and he has remained in custody for more than three months, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees
