====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-10-2019 Learned counsel for the petitioner is permitted to add complainant as O.P. No. 2 as a party in this case during course of day.

Petitioner seeks bail in anticipation of his arrest in connection with Complaint Case No. 302 (c ) of 2019, registered for the offences punishable under Sections 498 (A), of the Indian Penal Code.

As per complaint petition petitioner happens to be husband of the complainant and said to have assaulted her with respect to the demand of four wheeler vehicle. Submission of the learned counsel for the petitioner is that the whole allegation is false and concocted and he is still

On the other hand, learned counsel for O.P. No. 2 suo motu appeared and stated that after reconciliation she was sent for her Sasarul but again she was subjected to cruelty as such she is not ready to reside with the petitioner and petitioner happens to be husband he is not incurred expenses of the complainant.

Having heard both sides, considering the fact that it is a marital dispute this application is disposed of with a direction to the petitioner to surrender before the learned Court below within four weeks from the receipt of this order with condition that he has to pay Rs. 2500/- per month to O.P. No.2 for a period of one year and during that period it is expected that O.P. No.2 shall move before the Family Court for grant of her maintenance in which petitioner on service of notice has to appear and cooperate in disposal of the case and abide by any order passed by the Family Court unless and until the same is not modified or set aside by any higher Court, petitioner be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Five Thousand) with two sureties of the like amount to the satisfaction of

Case No.-302 (C) of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the Court concerned.

It is made clear that if petitioner fails to pay amount for three consecutive months to the O.P. No.2, she has liberty to move the learned lower Court for cancellation of bail bonds of the petitioner.
