The petitioners seek bail in anticipation of their arrest in connection with Nauhatta P.S. Case No. 194 of 2016 which has been instituted for the offences under Sections 147, 148, 149, 341, 323, 324, 379, 307 and 504

Patna High Court CR. MISC. No.70768 of 2019(2) dt.27-11-2019 2/2 of the Indian Penal Code.

Mr. Anant Kumar No.1, learned Advocate for the petitioners, has fairly stated that during course of investigation, the petitioners were on police bail. In that view of the matter, this petition would not be maintainable. The same is dismissed.

If the petitioners surrender before the court below and seek bail, the court below shall take into account the fact that the petitioners were on police bail and had not misused the privilege of bail, and shall pass appropriate orders, without being prejudiced by the fact that the present petition has not been entertained.
