Petitioners apprehend arrest in a case registered for the offences punishable under Sections 323, 307, 313, 498A, 504, 506/34 and other allied sections of the Indian Penal Code and Sections 3/4 of the Dowry Prohibition Act. It is a case of torture and harassment for nonfulfillment of demand of dowry. Petitioner is cousin brother-in-law of the opposite party No. 2.
Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in this
Patna High Court CR. MISC. No.75328 of 2022(2) dt.27-03-2023 2/2 case. It is next submitted that allegation is general and omnibus in nature and in-laws of the informant have already been granted bail vide order dated 16.03.2023 passed in Cr. Misc. No. 1812 of 2023. He is separate in mess and property and is not concerned with the affairs of the informant and her husband. Petitioner has got clean antecedent.
Considering the aforesaid facts and circumstances, let the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Sikrahana at Dhaka, East Champaran in Ghorasahan P. S. Case No. 355 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
