JUSTICE BIRENDRA KUMAR ORAL ORDER 16-01-2020 Petitioner No. 1 Baso Yadav and petitioner no. 2 Ram Bilash Yadav have already been arrested by the police in this case, hence, their prayer for anticipatory bail is dismissed as infructuous now.

Heard learned counsel for the petitioner no. 3 and 4 and learned Additional Public Prosecutor for the State. The petitioner no. 3 and 4 are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 307, 504 and 506 of the Indian Penal Code. Submission is that there is no specific allegation against the petitioner no. 3 Dilip Yadav and petitioner no. 4 Mahesh Yadav, rather they were simply members of the accused group. Further submission is that these petitioners have got no

Patna High Court CR. MISC. No.67726 of 2019(2) dt.16-01-2020 2/2 criminal antecedent. There is no material to substantiate that the petitioner no. 3 and 4 are going to tamper with the evidence or abscond the process of law.

Considering the aforesaid fact, let the petitioner no. 3 Dilip Yadav @ Dilip Kumar and petitioner no. 4 Mahesh Yadav @ Mahesh Kumar, in the event of their arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on anticipatory bail on furnishing bail bonds of Rs.20,000/- (rupees twenty thousand) each with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending in connection with Ladaniya Police Station Case No. 53 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner no. 3 and 4 shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner no. 3 and 4 and also the petitioner no. 3 and 4 shall not leave the country without permission of the court.
