JUSTICE MOHIT KUMAR SHAH ORAL ORDER 20-04-2024 The present writ petition has been filed seeking the following reliefs:- "1(i). For issuance of an appropriate writ / order / direction to quash the order bearing Memo No. 333 dated 25.03.2021 passed by District Magistrate, Banka whereby and whereunder the petitioner has been dismissed from his service on the post of Clerk working in the office of C.D.P.O. Banka with effect from the date of order.

(ii). For issuance of an appropriate writ / order / direction directing the respondent to make full

Patna High Court CWJC No.16694 of 2023(2) dt.20-04-2024 2/2 salary of the petitioner for the period of suspension that is from 13.07.2018 to the date of conviction that is 25.03.2021.

(iii). For issuance of an appropriate writ / order / direction to the respondent after setting-aside the order of dismissal of the petitioner and to make payment all the legal dues as well as all the retiral dues of the petitioner."

At the outset, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to challenge the order dated 25.3.2021, passed by the District Magistrate, Banka, by filing appropriate appeal. Liberty, so sought, is granted. 3.

It is needless to state that in case, appropriate appeal is filed within a period of two weeks from today, the same shall be considered by the appellate authority, on merits and a reasoned and a speaking order shall be passed, in accordance with law, within a period of six weeks, thereafter.

The present writ petition stands disposed off on the aforesaid terms.
