The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 307, 379 and other allied sections of the Indian Penal Code. As per the prosecution case, petitioner and other coaccused persons assaulted the informant with iron rod and lathi. Earlier also, the petitioner along with others fired gunshot and for the same one case is pending. The petitioner along with others pressurized the informant for withdrawing the pending case and on refusal they committed the alleged occurrence. It is submitted that allegation of assault is general and omnibus. There is case and counter case. Petitioner is not

Patna High Court CR. MISC. No.404 of 2023(2) dt.07-04-2023 2/2 accused in any other case which is alleged to have been lodged by the informant. Informant has also got criminal antecedent. Counsel for informant however vehemently opposed the prayer for bail.

Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai in connection with Begusarai Town P.S. Case No. 572 of 2022, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
