JUSTICE SHIVAJI PANDEY ORAL ORDER 06-07-2018 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks anticipatory bail in a case instituted for the offences under Sections 406 of the Indian Penal Code read with Section 3/4 of the Dowry Prohibition Act. Allegation has been made that the marriage of Puja Kumari was settled with Bikram Singh and in pursuance thereof by way of gift the other side has given rings, clothes and cash of Rs. 51,000/-.

Learned counsel for the petitioner submits that he has not received any amount and disputed the statement.

No.37352 of 2018 (2) dt.06-07-2018 2 /2 Looking to the facts and circumstances of the case, in the event of arrest or surrender within four weeks from today, let petitioner, namely, Ajay Singh @ Ajay Kumar, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Sub Divisional Judicial Magistrate, Rohtas, Sasaram in connection with complaint case no.244 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, subject to the further condition that petitioner will pay the amount of Rs. 51,000/- to opposite party no.2. In the event the petitioner would succeed in such circumstances, opposite party no.

2 will have to return the said amount alongwith interest at the rate 6%. The payment of said amount will be made in two installments, first will be on fifteenth day from today and another is next fifteenth day. But if petitioner failed to pay the said amount the benefit of bail granted to him will be treated to have been cancelled.
