Petitioner apprehends his arrest in a case registered for the offence punishable under Section 30(A) of the Bihar Prohibition and Excise Act, 2016.

Informant who is police officer has alleged recovery of foreign as well as country made liquor from a lane and the name of petitioner has been disclosed by the apprehended accused.

It has been submitted on behalf of the petitioner that neither he has been apprehended from the place of occurrence nor any illicit liquor has been recovered from his possession or from the house as such no offence under Excise Act is made out against him. Petitioner has got no criminal antecedent. Considering the aforesaid facts and circumstances of

No.72759 of 2019(2) dt.21-01-2020 2/2 the case, let the petitioner named above in the event of his/her arrest or surrender before the court below within a period of four weeks, be released on anticipatory bail upon furnishing bail bond of Rs. 20,000/- with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Akberpur P.S. Case No. 345 of 2019, subject to the conditions as laid down under Section 438(2) of Cr.P.C.
