The petitioner seeks regular bail in connection with Begusarai Town P.S. Case No. 107 of 2018 for the offences punishable under Sections 302 and 201 of the Indian Penal Code. The allegation is regarding unknown persons having killed the deceased lady.

The learned counsel for the petitioner has submitted that the actual fact of the case is that the deceased lady had solemnized love marriage with one Kunal and was living with her husband, whereafter in the meantime, it is said that she had developed relationship with one Mukesh and got pregnant, whereafter the deceased lady was pressurizing the said Mukesh to solemnize marriage with her but the said Mukesh had a suspicion that the pregnancy was on account of relationship of the victim

Patna High Court Cr.Misc. No.33768 of 2018 (3) dt.25-07-2018 2/3 lady with her husband Kunal. In such view of the matter, the said co-accused Mukesh had killed the deceased lady. Nonetheless, it is submitted that at best it may be either of the said Mukesh or Kunal who may be responsible for murder of the victim lady but so far as the petitioner is concerned, he has no concern with the victim lady, hence he has got no complicity in the matter. The petitioner is having clean antecedent and is languishing in custody since 06.03.2018.

Having regard to the facts and circumstances of the case, the fact that prima-facie case is made out against Mukesh, who is said to be having a love affair with the victim lady as also the fact that the mother of the victim lady has stated in her statement before the police that the victim lady had gone with her husband to Delhi prior to recovery of the dead body of the victim lady, I deem it fit and proper to enlarge the petitioner on regular bail.

Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Begusarai Town P.S. Case No. 107 of 2018.

No.33768 of 2018 (3) dt.25-07-2018 3/3 It is further directed that the petitioner shall mark his attendance before the concerned Police station on every Monday of the week at 10 A.M. and co-operate in the investigation.
