The petitioner seeks regular bail in connection with Manjhi P.S. Case No. 256 of 2019 registered for the offence punishable under Sections 30, 30(g), 38(i)(ii) of the Bihar Prohibition And Excise Act, 2016.

The allegation against the petitioner is that a KWID Car was intercepted by the Police and a total quantity of 120 liters of illicit liquor has been recovered from the said Car. Learned counsel appearing on behalf of the petitioner submits that petitioner has falsely been implicated in this case inasmuch as the vehicle from which the illicit liquor was recovered does not belong to the petitioner. Patna High Court CR. MISC. No.69130 of 2019(2) dt.04-12-2019 2/2 further submits that petitioner has got no criminal antecedent. Learned counsel also submits that similarly situated co- accused persons namely, Raju Singh and Bittu Kumar have been granted bail by this court vide Cr. Misc. No. 70864 of 2019 and Cr. Misc. No. 68940 of 2019 respectively. Learned counsel submits that petitioner is in custody since 02.09.2019. Having heard learned counsel for the parties and taking into consideration the fact that petitioner has got no criminal antecedent, similarly situated co-accused persons have been granted bail by this Court and petitioner is in custody since 02.09.2019, I am inclined to enlarge the petitioner on regular bail.

Accordingly, let the petitioner, above named, be enlarged on bail on furnishing bail bonds of Rs. 20,000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge- II-CumSpecial Judge, Excise, Saran at Chapra in connection with Manjhi P.S. Case No. 256 of 2019.
