The petitioner seeks bail in connection with Rajoun P.S. Case No. 32/2018 dated 24.01.2018 instituted for the offence under Section 394 of the Indian Penal Code.
The F.I.R. is against unknown. The informant is alleged to have been robbed of his belongings, including cash and motorcycle. He was carrying the identity card and other documents of some of the other investors, from whom the informant had collected money of the premium. During the course of investigation, the petitioner was arrested on suspicion but from his possession, keys of a motorcycle and Adhaar Cards of some of the investors were found.

Patna High Court Cr.Misc. No.35994 of 2018 (2) dt.06-07-2018 2/2 has submitted that the petitioner was arrested only on suspicion and maliciously and forcibly, the police has shown the recovery of motorcycle and certain documents from the possession of the petitioner. Cash amount of Rs. 9,480/- is also said to have been recovered. There is nothing on record to suggest that the currency notes, which have been recovered, were part of the looted property. No identification number of mark of the currency note has been discerned.
The petitioner is in custody since 06.02.2018. Considering the aforesaid facts and also the period of custody of the petitioner, he is directed to be released on bail on his furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Banka in connection with Rajoun P.S. Case No. 32/2018.
