JUSTICE SANDEEP KUMAR ORAL ORDER 16-05-2023 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. The petitioner seeks regular bail in connection with Sonepur P.S. Case No. 426 of 2022, registered for the offence punishable under Sections 447, 342, 323, 324, 307/34 of the Indian Penal Code and section 27 of the Arms Act. The allegation against the petitioner is that he along with other accused went to the house of informant and assaulted them. There was land dispute between the parties. Learned counsel for the petitioner submits that the petitioner is innocent and falsely been implicated in this case. Petitioner has no criminal antecedent. Similarly situated three co-accused persons namely Harendra Ray and Mithlesh Kumar @ Mithlesh Rai and Anil Rai have been granted regular bail
Patna High Court CR. MISC. No.6579 of 2023(2) dt.16-05-2023 2/2 vide order dated 01.02.2021 passed in Cr. Misc. No. 35636/2020 and vide order dated 22.09.2022 passed in Cr. Misc. No. 38341 of 2022. Petitioner is in custody since 22.09.2022. Learned APP has vehemently opposed the prayer for bail.
Considering the nature of allegation levelled against the petitioner, his period of custody, this application is allowed. Let the petitioner, above named, be released on bail, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Saran in connection with Sonepur P.S. Case No. 426 of 2020.
This is also subject to the condition that (I) the petitioner would cooperate in the proceeding of the court below. In the event of failure to appear on two consecutive dates, the court below will be at liberty to pass appropriate order including cancellation of bail bonds of the petitioner.
