Petitioner, already in custody, seeks bail in connection with Jakkanpur PS Case No.65 of 2018 registered under Sections 147, 148, 149, 341, 323, 325, 307 and 384 of the Indian Penal Code.

Allegation in brief is that on account of demand of extortion money, Baban Yadav and his associates including the petitioner assaulted the informant's staff Sunil Singh. Learned counsel for the petitioner submits that the informant as well as the petitioner both are bus agents and due to rivalry of the bus business, this false implication is made

Patna High Court Cr.Misc. No.36036 of 2018(2) dt.22-06-2018 2/2 alleging demand of extortion though the petitioner has no criminal antecedent, the allegation of assault is general and omnibus and all injuries are simple in nature. Having considered the aforesaid facts and circumstances, petitioner Mallu Rai @ Mallu Chaudhary is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Patna in connection with Jakkanpur PS Case No.65 of 2018.
