====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 01-12-2025 Heard learned counsel for the petitioner, learned A.P.P. for the State, and learned counsel for the informant.
2. The petitioner seeks bail in a case registered for offences punishable under Sections 140(2), 61(2), and 103(1) of the B.N.S., 2023.
3. As per the prosecution case, the informant alleged that on 10.05.2025, accused Shubham Kumar came and took the son of the informant with him on the pretext of returning his money. Later, accused Shubham Kumar demanded Rs. 2 lakhs and threatened to kill the son of the informant if the amount was not paid.
4. Learned counsel for the petitioner submits that the petitioner is named in the F.I.R. only on the basis of the confessional statement of the co-accused, Shubham Kumar. The
Patna High Court CR. MISC. No.76312 of 2025(3) dt.01-12-2025 2/2 petitioner is in custody since 11.08.2025 and the charge-sheet has been submitted in this case.
5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.
6. Considering the nature of the accusation and the period of custody, the prayer for grant of bail to the petitioner is allowed.
7. Accordingly, let the above-named petitioner be released on bail on furnishing a bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each, to the satisfaction of the learned C.J.M., Motihari, East Champaran, in connection with Chakiya P.S.
