====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 04-07-2018 Heard Mr. Javed Aslam, learned counsel for the petitioner and Sri Ashok Kumar, learned Addl. Public Prosecutor.

The sole petitioner, apprehending his arrest in Barauli P.S. Case No. 91 of 2018 registered for offence under Section 30(a) of the Bihar Prohibition & Excise Act, 2016, has prayed for grant of anticipatory bail.

By way of referring to the F.I.R., learned counsel for the petitioner submits that in this case, recovery of 8.640 litres of Indian Make Foreign Liquor was affected besides a public road and the petitioner has falsely been implicated. It has been argued that it appears that since long back in the year 2011 the petitioner was made accused in one case, due to which the petitioner without any rhyme and reason has been made

Patna High Court Cr.Misc. No.37939 of 2018(2) dt.04-07-2018 2/2 accused. Learned counsel for the petitioner submits that no recovery was made either from the conscious possession of the petitioner or his premises/land.

Be that as it may, considering the nature of accusation as well as the fact that nothing was recovered from the conscious possession of the petitioner, in the event of his arrest or surrender within a period of six weeks from today, let the petitioner, namely, Megha Singh @ Subas Singh @ Subhas Singh be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Addl. Sessions Judge-cumSpecial Judge, Gopalganj in connection with Barauli P.S. Case No. 91 of 2018, subject to conditions as laid down in Section 438(2) of the Code of Criminal Procedure.
