JUSTICE MOHIT KUMAR SHAH ORAL ORDER 09-02-2021 The present petition has been filed for restoring of writ petition bearing CWJC No. 166971 of 2011, which has stood dismissed on account of non-prosecution by an order dated 01.04.2016.

The learned counsel for the petitioner submits that on account of mistake of his clerk, the case could not be marked, hence on account of non-appearance, the writ petition has stood dismissed.

Having regard to the facts and circumstances of the case and considering the averments made in the present petition,
