The petitioner seeks bail in Khutauna P.S. case No. 102/2018 registered under Section 323, 324, 307, 504/34 of the Indian Penal Code.
The informant named four persons and alleged that all the four accused persons surrounded him and began to abuse. Shiv Kumar Yadav, the petitioner, is alleged to have assaulted the informant with axe which hit on his forehead. Other accused persons also assaulted the informant. Mukesh assaulted the informant with plank of wood which hit above the eye. The learned counsel for the petitioner submits that informant, Kanhaiya Kumar, got only one incised wound. The informant was treated in DMCH, Darbhanga and thereafter he got his treatment in Paras Global Hospital, Darbhanga. The
Patna High Court CR. MISC. No.71419 of 2019(3) dt.06-03-2020 2/2 opinion of the injury was kept reserved but till date opinion of the injury has not been obtained. The petitioner is in custody since 27.08.2019. The petitioner has remained in jail for more than six months.
Considering the facts aforesaid and the nature of allegation made against the petitioner, the petitioner, above named is directed to be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-III, Jhanjharpur in connection with Khutauna P.S. case No. 102/2018.
