The petitioner is languishing in custody since 19.07.2019 in a case registered for the offences punishable under Sections 302 and 201 of the Indian Penal Code. The prosecution case is that the daughter of the informant went missing but subsequently, her dead body with slit neck was recovered, leading to registration of the FIR against unknown. During investigation, it transpired that the son of the petitioner having love affairs with the daughter of one Aftab Sai but since the petitioner belongs to Hindu community and the victim belonged to Muslim community, she was killed and hence, it is a case of honour killing.

It is submitted by learned counsel for the petitioner

Patna High Court CR. MISC. No.70853 of 2019(2) dt.27-11-2019 2/2 that the involvement of the petitioner and her son in the alleged occurrence sprang up during investigation and petitioner is a lady. A statement has been made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent. Learned APP submits that the name of the petitioner sprang up during investigation.

Considering the thrust of accusation against the son of the petitioner, investigation already being concluded and petitioner being a lady, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan in connection with Pachrukhi P.S. Case No. 108 of 2019. (Dinesh Kumar Singh, J) DKS/- U T
