2. Petitioner seeks regular bail in connection with Saharsa Sadar P. S. Case No. 72 of 2025 registered for the offences punishable under Sections 140(3), 103(1), 238 and 61(2) read with Section 3(5) of the Bharatiya Nyaya Sanhita.
3. As per the prosecution case, on 23.12.2020, the son of the informant went missing and his mobile phone was also found switched off. It is further alleged that during the course of the investigation, the petitioner has been dragged as an accused mainly on the basis of circumstantial evidence.
4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. The petitioner is the brother of the co-accused Diwani Devi with whom it is alleged that the deceased had an affair. It is further submitted that except the confessional
Patna High Court CR. MISC. No.74982 of 2025(2) dt.13-11-2025 2/2 statement of the co-accused, there is nothing on record to show the complicity of the petitioner. It is next submitted that there is delay of 24 days in lodging the FIR without giving any plausible reason for the same. Similarly situated co-accused person, Diwani Devi, has already been granted bail by the Co-ordinate Bench of this Court vide order dated 19.08.2025 passed in Cr. Misc. No. 56550 of 2025. Petitioner has one criminal antecedent and he is in custody since 23.06.2025. Charge-sheet has already been submitted.
5. However, learned A.P.P. for the State vehemently opposed the bail application.
6. Considering the nature of accusation and period of custody, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saharsa/concerned Court below in connection with Saharsa Sadar P. S. Case No. 72 of 2025.
