The petitioner is languishing in custody in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 307, 386, 387 of the Indian Penal Code and Section 27 of the Arms Act. The prosecution case as per F.I.R is that all the F.I.R named accused persons including the petitioner surrounded the informant and his nephew and demanded ransom amount of Rs. 50,000/- and when the informant

Patna High Court CR. MISC. No.77988 of 2023(2) dt.07-12-2023 2/3 replied that he is unable to pay extortion demand, he and his nephew were assaulted by the accused persons including the petitioner.

It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case. There is general and omnibus allegation against the petitioner. The injuries of the injured have been found to be simple in nature. The petitioner has been remanded in this case on 17.02.2023 and since then he is in custody.

In contra, learned A.P.P appearing on behalf of the State has vehemently opposed the prayer for bail of the petitioner.

Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-III, Naugachia, Bhagalpur in connection with Nadi
