The petitioner, in the present case, is seeking regular bail in connection with Jagdishpur P.S. Case No. 234 of 2018, registered for offences alleged under Section 30(A) of Bihar Prohibition and Excise Act, 2016.
It is submitted that the petitioner has no concern with the vehicle in question from which the recoveries have been made. Learned counsel submits that the petitioner was only a passenger in the vehicle and has got no criminal antecedent. He is in custody since 10.05.2018, Learned A.P.P. for the State is present.
Considering the fact that the recovery of illicit liquor
Patna High Court Cr.Misc. No.34269 of 2018 (2) dt.13-06-2018 is from a vehicle which does not belong to the petitioner and that the petitioner has no criminal antecedent, let the petitioner, above named, be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Additional District & Sessions Judge-cum-Special Judge, Excise, Bhagalpur in connection with Jagdishpur P.S. Case No.234 of 2018, subject to the conditions under Section 437(3) Cr.P.C.
