JUSTICE ASHUTOSH KUMAR ORAL ORDER 04-12-2019 The petitioner seeks bail in connection with Dagarua P.S. Case No. 95 of 2019 which has been instituted for the offences under Sections 272, 273 of the Indian Penal Code and Sections 30(a), 41, 47 of the Bihar Prohibition & Excise Act, 2016.
On secret information that two of the notorious persons dealing in liquor are traveling by a vehicle, the vehicle was intercepted and the aforesaid two persons viz. Ranjan Jaiswal and Vikash Kumar Keshri were arrested. From the vehicle in which they were traveling, 21 litres of foreign liquor was recovered. The aforesaid two persons stated that in the vehicle which is coming
Patna High Court CR. MISC. No.68130 of 2019(2) dt.04-12-2019 2/3 from behind, there is a huge consignment of liquor which belongs to them. On such communication, the other vehicle was intercepted which was found to be driven by the petitioner. Hence, the implication of the petitioner in this case.
Learned counsel for the petitioner has submitted that petitioner only served as a driver of the transporting vehicle and had absolutely no idea or concern about the commodity which was being transported. It has further been submitted that the aforesaid Ranjan Jaiswal and Vikas Kumar Keshri have been granted bail by a coordinate Bench of this Court. The petitioner is in custody since 16.06.2019 and does not have criminal antecedents.
Considering the aforestated facts, the petitioner, above named, is directed to be released on bail on his furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Additional District Judge-II-
