JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 19-07-2018 Heard the learned counsel for the petitioner and learned counsel appearing on behalf fo the State. The petitioner is in custody in connection with Dhanaha P.S. Case No. 204 of 2017 for the offence under Sections 363, 365, 34 of the Indian Penal Code. Learned counsel for the petitioner submits that in the instant case case diary was called for from the court of learned A.C.J.M., Bagaha, West Champaran, vide order dated 28.06.2018. Petitioner is in custody since 02.04.2018, he further submits that petitioner was last seen with the victim. Learned A.P.P. appearing on behalf of the State after perusal of the case diary submit that petitioner as well as victim have criminal antecedent.

Considering the fact that in the case diary it has come

No.34560 of 2018(3) dt.19-07-2018 2/2 that the petitioner as well as deceased have criminal antecedent, petitioner is in custody since 02.04.2018, the petitioner, named above, is directed to be released on bail after 02.09.2018 on furnishing bail bonds of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Bagaha, West Champaran, in connection with Dhanaha P.S. Case No. 204 of 2017.
