The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Muzaffarpur Town P.S. Case no. 07 of 2022 instituted for the offence under Sections 419, 420, 467, 468, 471 and 34 of the Indian Penal Code.

Allegation against the petitioner along with other is that they committed fraud by producing fake signature of the informant before the Executive Officer through some fake documents and they had submitted an affidavit stating therein that the informant has voluntarily given her share of land to her brother and nephews.

Patna High Court CR. MISC. No.80958 of 2023(6) dt.05-07-2024 2/3 Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. The present dispute is civil in nature. A statement has been made in para-3 of this petition that the petitioner has got no criminal antecedent. He has not committed any fraud. It is submitted by learned counsel for the petitioner by way of supplementary affidavit dated 22.06.2024 in para-3 that petitioner and others have settled their dispute with the informant with the help of intervention of some common wellwishers, friends and co-villagers vide compromise petition dated 03.06.2024 before the learned Court below. In support of this, compromise petition has been annexed herewith and marked as Annexure-P/D to this petition. Other co-accused person has already been granted regular bail by this Court vide order dated 08.09.2023 in Cr. Misc. No. 59501 of 2023.

Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to surrender in the Court below within a period of four weeks from today and in the event of his arrest or surrender in connection with Muzaffarpur Town P.S. Case no. 07 of 2022, he will be enlarged on bail on furnishing bail bond of Rs.

Patna High Court CR. MISC. No.80958 of 2023(6) dt.05-07-2024 3/3 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur subject to the conditions as laid down under section 438(2) of the Cr.P.C.
