The petitioner disputes the fact that the compensation has been given to the petitioner treating his land as agricultural but he wants payment of compensation treating his land as commercial.

In view of the aforesaid, the petitioner has liberty to move the Commissioner-cum-Arbitrator under the provisions of National Highway Act and the same shall be decided in accordance with law by the Commissioner-cum-Arbitrator within three months from the date of receipt / production of a copy of this order.

If the petitioner is still aggrieved by the order of the

Patna High Court CWJC No.22040 of 2019(5) dt.10-10-2022 2/2 Commissioner-cum-Arbitrator , the District Judge, Muzaffarpur under Section 34 of the Arbitration and Conciliation Act. With the aforesaid observation and direction, this writ petition is disposed of.
