The petitioners are apprehending their arrest in connection with Maharajganj P.S. Case No.189 of 2017, registered for offences punishable under Sections 302, 120(B) and 34 of the Indian Penal Code.
Allegation against the petitioners is that some of the informant left the hourse for Chapra. Later on he received information that one Ashok Prasad has killed her son. Five persons have been named in the FIR but the petitioner has not named in the FIR but later on his name has transpired during the course of the investigation.
Submission of the learned counsel for the petitioners is that
Patna High Court Cr.Misc. No.34945 of 2018 (2) dt.06-07-2018 2/2 except confessional statement, nothing is found against the petitioner and the co-accused on whose confessional statement, petitioner has been made accused, has already been granted privilege of bail by a coordinate Bench of this Court vide order dated 17.05.2018 passed in Cr. Misc. No.22087 of 2018. Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioners, above named, in the event of arrest or surrender before the Court below within a period of six weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.25,000/-(Twenty Five thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-V, Siwan, in connection with Maharajganj P.S. Case No. 189 of 2017, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure.
