The petitioner has been in custody since 23.03.2018 in connection with Jalalgarh P.S. Case No. 40/2018 registered for the offences punishable under Sections 436/506/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that only on the basis of suspicion, the petitioner has been named in the First Information Report and on the said basis, the petitioner was also attacked for which he has filed a separate case. He has submitted that the petitioner has filed his statement at Jalagarh Primary Health Centre and on the basis of such statement, the First Information Report (Annexure-2) has also been registered.

Considering the nature of allegation and that there is case and counter case between the parties and also there is history of previous enmity, let the petitioner above named, be released on bail on
