The petitioner is languishing in custody for the offences punishable under Sections 302/201/34 of the Indian Penal Code and Section 27 of the Arms Act.

The informant learnt that during a marriage ceremony the petitioner fired as amusement which hit one Satyendra Kumar Yadav as well as to the petitioner. Satyendra Kumar Yadav died as a result of that injury.

Learned counsel for the petitioner submits that there is no post mortem report; rather the medical report, copy at Annexure-2, shows that Satyendra Kumar Yadav died due to sudden cardiac attest.

Considering the fact that neither the informant is an

No.67522 of 2019(4) dt.04-03-2020 2/2 eyewitness of the occurrence nor the evidence was corroborated by medical evidence, let the petitioner, above named, who is in custody since 10.07.2019, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Shahpur P.S. Case No.275 of 2019, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. (c) The petitioner shall not leave the country without permission of the trial Court.
