JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 02-07-2018 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks pre-arrest bail in connection with Phulwaria P.S. Case No.117 of 2017 registered under Sections 149, 453A, 353A, 295A, 332, 327, 337 and 487 of the Indian Penal Code as well as Sections 3 and 4 of the Explosive Substances Act.

It is submitted by the learned counsel for the petitioner that forty persons have been named in the first information report, out of whom more than twenty persons have been granted prearrest bail by different Benches of this Court. The case of the petitioner stands on identical footing to those who have already

In support of his submission he has drawn my attention towards the orders passed by this Court as contained in Annexure-2 series to the present application. Learned counsel for the State does not controvert the assertions made by the learned counsel for the petitioner that the case of the petitioner stands of identical footing to that of those who have already been granted pre-arrest bail. In view of the submissions made above, in the event of arrest or surrender in the court below within six weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Begusarai in connection with Phulwaria P.S. Case No.117 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
