2. The petitioner seeks regular bail in a case registered for the offence under Sections 341, 323, 504, 506, 307/34 of the Indian Penal Code and Section 27 of the Arms Act.
3. As per the prosecution case, the assailant of the deceased are co-accused Ritesh Singh @ Tutu and Niraj Singh. There is general and omnibus allegation against the petitioner. Petitioner is in jail since 23.02.2023.
4. Considering the facts and circumstances of the case, this application for regular bail is allowed.
5. Let the petitioner, above named, be released on bail after framing of charge if the charge has not been framed
Patna High Court CR. MISC. No.79598 of 2023(3) dt.05-03-2024 2/2 yet and on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District & Sessions Judge-3rd, Rohtas at Sasaram/concerned Court below in connection with C.I.S./S. Tr. Case No. 663 of 2023 arising out of Karakat P.S. Case No. 42 of 2023 subject to the condition that:- 5(i) The petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the Court and on absence on two consecutive dates without sufficient reason, the bail bond of the petitioner shall be cancelled by the Court below.
6. This application stands allowed.
