The petitioners apprehend their arrest in Deepnagar P.S. case No. 236 of 2019 registered under Section 147, 148, 149, 341, 323, 324, 307, 353, 337, 338, 224, 225 of the IPC and u/s 27 of the Arms Act.

The gist of the allegation is that informant went to arrest Ajay Singh, an accused of Deepnagar P.S. case No. 167 of 2019, but his family members and others started pelting stones in which informant sustained injuries. Accused Ajay Singh got released and he went inside the house and fired from his pistol. The learned counsel for the petitioners submits that petitioners are not the family members of Ajay Singh. The name of the petitioners were disclosed by the Chowkidar who is on inimical term with the petitioners. It is further submitted that one Satyendra Singh was under treatment in Pune and he was living with his son and a certificate to this effect was given by

Patna High Court CR. MISC. No.69069 of 2019(2) dt.15-11-2019 2/2 Major Arshdeep Kaur, Officer Commanding, but he has also been made accused in the case. It is further submitted that similarly situated accused Nagina Singh has already been granted anticipatory bail vide order passed in Cr. Misc. No. 65341 of 2019.

Taking into consideration the facts aforesaid and the fact that similarly situated accused has already been granted anticipatory bail, the petitioners, above named, in the event of their arrest/ surrender before the court below within a period of four weeks from the date of receipt/ production of a copy of this order are directed to be enlarged on bail on their furnishing bail bond of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda, Bihar Sharif in connection with Deepnagar P.S. case No. 236 of 2019, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
