In this case, the petitioner is seeking anticipatory bail in connection with Rivilganj P.S. Case No.27 of 2018, registered for the offence punishable under Sections 341, 323, 307, 435, 380 and 448/34 of the Indian Penal Code.
As per the F.I.R., six unknown persons entered into the house of the informant and tied up the family members of the informant and thereafter entered into the other house and what was being done is unknown. Later on, Raj Kumar Sah, who happens to be father-in-law of his younger brother, was
Patna High Court Cr.Misc. No.36959 of 2018(2) dt.02-07-2018 2/3 identified. They have assaulted the informant with fists and slaps and took away Rs.80,000/-.
Learned counsel for the petitioner submits that it is nothing but a fiction story on account of marriage dispute, which led to institution of another criminal case by daughter of the petitioner being Sisuan P.S. Case No.65 of 2018, for the offence punisbhable under Sections 498A/406/379/34 of the Indian Penal Code and under Section 3/4 of the Dowry Prohibition Act, in fact, in order to settle the score, this false story has been planted.
Looking to the entire facts and circumstances of the case, let the petitioner, namely, Raj Kumar Sah, be released on anticipatory bail in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of the A.C.J.M., VIII, Saran at Chapra, in connection with Rivilganj P.S. Case No.27 of 2018, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure. Further condition is that whenever the police will call the petitioner for the purposes of investigation and interrogation, he will remain present for the investigation.
