2. The petitioner seeks regular bail in connection with Chandradeep P.S. Case No. 107 of 2023 registered for the offence under Sections 366A / 34 of IPC and Section 8 of the POCSO Act.

3. As per the prosecution case, the allegation against the petitioner is that he alongwith his elder brother kidnapped the daughter of the informant.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. He is in custody since 17.06.2023.

5. However, learned APP for the State vehemently opposed the prayer for regular bail.

6. On perusal of the FIR, case diary and impugned

Patna High Court CR. MISC. No.77863 of 2023(3) dt.15-03-2024 2/2 order dated 21.09.2023 passed by learned A.D.J. - I - cum - Special Judge SC /ST POA, Act & POCSO, Jamui, it appears that Statement of the victim recorded under Section 161 of Cr.P.C. in which she has stated that on 01.06.2023 at 4 PM without informing any person of her relative she has gone with the petitioner with her own will and solemnized marriage in a temple and on perusal of the statement of victim recorded under Section 164 of Cr.P.C. age of victim as asserted by her is 18 years but after assessment by learned Magistrate her age is about 16 years and no allegation is made against the petitioner.

Considering the aforesaid facts and circumstances of the case also also taking into account the period of custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge - I - cum - Special Court, SC / ST Act and POCSO Act, Jamui in connection with Chandradep P.S. Case No. 107 of 2023.
